租车协议
I.定义。“合同”指本表格正反两面找到的所有条款和条件。“您”或“您的”指本合同中其他地方标识为客户的人、任何签署本合同的人、任何被授权的驾驶员以及任何按我们或客户的指示被我们向其收费的人或组织。所有被称为“您”或“您的”人均共同并各自受本合同约束。“我们”、“我们的”或“我们”指本合同反面所列的企业名称。“授权驾驶员”指租赁者以及我们在本合同上列出的任何额外驾驶员,前提是该人持有有效驾驶执照。只有授权驾驶员才能驾驶车辆。“车辆”指本合同中标识的汽车或卡车及我们为其替换的任何车辆,以及其所有轮胎、工具、配件、设备、钥匙和车辆文件。“CDW”指碰撞损害豁免。“物理损害”指因碰撞或倾覆导致的车辆损坏或丢失;它不包括综合损害或损失,如:车辆因盗窃丢失;故意破坏;自然灾害;暴动或民众骚乱;冰雹、洪水;或火灾。物理损害不包括非由碰撞或倾覆引起的内部烧孔、玻璃星状裂纹或裂缝。“使用损失”指由于租赁期间损坏或丢失导致我们无法使用车辆进行任何目的的损失。使用损失通过将车辆损坏或丢失之日起至其修复或更换之日的天数乘以每日租赁率计算得出。
II.租赁、赔偿和保证。这是一份车辆租赁合同。如果车辆被遗弃或违反法律或本合同使用,我们可在不通知您的情况下收回车辆,并由您承担费用。您同意赔偿我们、为我们辩护并使我们免受所有因此次租赁及您使用车辆而产生或引起的所有索赔、责任、成本和律师费。我们对车辆不作任何明示、暗示或明显的保证,不保证其商品性和特定目的的适用性。
III.车辆的条件和归还。您必须将车辆归还至本合同指定的日期和时间、且状态与您接收时相同(正常磨损除外)。如果车辆在营业时间之外归还,直到我们在下一个营业日检查车辆之前,您仍对车辆的安全以及任何损坏或丢失负责。租赁期间对车辆的服务或更换零件或配件必须事先获得我们的批准。您必须检查并维护所有液体的水平。
1.车辆归还时间 归还时间与取车时间相同。例如,如果您下午3点取车,您必须在归还日的下午3点前归还。
我们的营业时间为上午9:00至下午7:00。如果您需要在这些时间之外归还车辆,将收取每分钟1美元的费用。
2.如果您预付定金并在取车时请求更换车辆,您可以更换至另一辆当前未被预订的租赁车辆,但定金不予退还且不可交换。
3.延长租赁期限 如需延长租赁,请在归还时间前24小时通知我们。我们将确认并向您收取延期当天的租赁价格。如果您在归还时间后24小时内通知我们,将额外收取200美元的迟还费用,加上延长租赁的价格。如果您在超过归还时间后通知我们延期,将额外收取500美元的迟还费用,加上延长租赁的价格。如果您未能按时归还车辆且我们无法联系到您,我们保留拖车的权利,并向您收取拖车、停车、人工等费用。
4.我们不同意因个人偏好在完成租赁手续并驾车离开后更换车辆。如果您坚持更换车辆,意味着此车的租赁期已结束,您开始租赁一辆新车并开始一个新合同。
IV.损害或丢失的责任;报警。您对车辆的所有损失或盗窃、或损坏负责,包括修理费用,或如果车辆无法修复或我们选择不修理,则车辆损失之日的实际现金零售价,加上使用损失、由于损坏或修理造成的车辆价值降低,以及我们在处理索赔时产生的行政费用。您必须尽快向我们和警方报告所有事故或盗窃和故意破坏事件。
V.损害豁免。如果您购买了碰撞损害豁免(CDW)并在归还车辆时支付费用,我们将放弃向您收取车辆物理损害部分的权利。(损害豁免保险仅对21岁及以上的驾驶员适用。如果您小于21岁,您需要为您产生的全部损失负责)(a)由非授权驾驶员造成,或由任何人在任何管辖区的驾驶执照被暂停时造成;(b)由任何人在处方药或非处方药或酒精影响下造成;(c)由任何人在向我们提供虚假、欺诈或误导信息的情况下获得车辆或延长租赁期限时造成;(d)在车辆用于任何非法目的或在任何情况下构成违法,除了轻微交通违规外;(e)在搭载人员或财产进行收费或在推拉任何物品,或在任何赛车、速度测试或竞赛中使用时;(f)在教授任何人驾驶时;(g)在搭载危险或有害物品或车辆内外的非法物品时;(h)在超出合同背面指示的地理限制外使用时;(i)当其超载时;(j)在非铺装道路上驾驶时;(k)在运输超过车辆安全带数量的人员,或在乘客舱外搭载人员时;(l)在未按法律要求使用经批准的儿童安全座椅运输儿童时;(m)发生时里程表被篡改或断开;(n)当车辆的液位低,或合理预期您知道继续操作会损坏车辆时;(o)由于未适当固定货物造成的结果;(p)如适用,由于任何人缺乏操作手动变速器的经验造成;(q)是您故意、蓄意或鲁莽行为的结果;(r)发生时您未召集警方到场调查涉及人身伤害或财产损害的任何事故;或(s)由车内运输的动物造成的,我们不会放弃此权利。
VI.租赁期间的机械故障和人为情况
1.我们负责租赁使用期间车辆固有的机械故障,如发动机、变速箱、底盘、刹车等。您可以前往我们指定的修理店进行检查和修理。如果车辆被发现有固有问题,我们将以等值车辆替换。在允许的里程限制内,租赁期间在我们指定的修理店免费进行维护。如果使用期间任何机械警告灯亮起,请立即联系我们,以确保驾驶安全。
2.人为情况由租赁者负责。人为情况包括:轮胎爆裂、车辆电池放电、车辆被破坏、窗户损坏、车内物品被盗。我们不会赔偿现金损失。保管好您的贵重物品,不要将它们留在车内。我们提供24小时救援服务联系信息,但您需要联系并支付这些服务。
VII.保险。您对您造成的所有损害或损失负责。您同意提供涵盖您、我们和车辆的汽车责任、碰撞和全面保险。在州法律要求我们提供汽车责任保险,或如果您没有汽车责任保险的情况下,我们提供汽车责任保险(“政策”),该保险为任何其他有效和可收集保险的次要保险,无论是主要的、次要的、超额的还是偶然的。该政策提供第三者人身伤害和财产损害责任保险,限额不高于适用损失法律的州规定的最低水平。您和我们拒绝PIP、医疗支付、无过错和未投保及不足额投保驾驶员保险,在法律允许的情况下。如果您违反本合同的条款,或如果您未能配合我们或我们保险公司进行的任何损失调查,该政策将无效。
VIII.费用。您将按照本合同的要求,向我们或适当的政府当局支付所有应付费用,包括但不限于:(a)您保留车辆期间的时间和里程费用,或如果里程表被篡改或断开,则基于我们的经验收取的里程费用;(b)额外驾驶员费用;(c)您购买的可选产品和服务;(d)燃油,如果您归还车辆时油量少于租赁时;(e)适用的税费;(f)所有停车、交通和过路费违规、罚款、没收、法院费用、拖车、扣留和存储费用以及其他涉及车辆的费用,除非这些费用是我们的过错;(g)如果您未归还车辆或我们根据本合同的条款选择回收车辆,则从租赁地点到车辆归还地、被回收或被遗弃地之间每英里50美元加上我们在寻找和回收车辆时产生的所有其他费用;(h)我们因向您收款或以其他方式执行本合同下的权利而产生的所有费用,包括诉讼前和诉讼后的律师费;(i)所有逾期金额的每日100美元滞纳金,或法律允许的最高金额;(j)如果您用任何原因退回的支票向我们支付,则收取50美元或法律允许的最高金额,以较高者为准;以及(k)如果车辆归还时明显不如租赁时清洁,则收取不超过350美元的合理清洁费。
部分费用详情:

2.租赁期间产生的超额里程费用(不同车辆的里程限制和超额里程价格将在交车时解释并在车辆单独的合同中注明;一般设置为每天125英里,每周800英里,每月2000英里)。可以在合同签署之前通过支付一定比例的租赁费用升级为不限里程,或以半价超额里程价格预购里程。
3.燃油费用:以租赁开始时相同的油量归还车辆。如果归还时油量少于开始时,需要支付相应的燃油费用(大致标准:日系车每季20美元,德系车每季25美元,额外加收10美元劳务费)。
4.清洁费:a. 常规清洁:20 - 300美元 b. 液体清洁:200美元 c. 宠物毛发清洁:300美元 d. 恶臭(例如,大麻):300美元

IX.押金。我们有权使用您的押金支付根据本合同欠我们的任何金额。
1.不同车型的押金:

(豪华车型(车价通常在50,000usd~$75,000区间):$1000/1500
(超豪华车型(车价$75,000usd及以上):$2000/$5000
2.押金退还制度:
a.您在用车过程中造成的车损(0起赔额不计车损价值,但无法豁免误工费)、高速费及服务费、罚单及服务费、拖车费、劳工费用、油费/充电费用、停车费、超时费用等等,都会从押金里扣除。每项扣费在还车后都会有详细说明
b.因为美国查询高速费/罚单时间较长,所以我们会冻结$200押金,来支付停车费/高速费及相关服务费用,$200之外的押金,会在还车之后的1个工作日(1~3个自然日)内安排退还
c.您允许我们将您支付押金的信用卡信息记录在册,以防在押金全部退还后,再收到有关合同内容的新增费用
d.信用卡预授权无实际消费产生,我们只是冻结部分信用额度。冻结解除后,每个银行的额度恢复时间长短不一,也不会有银行方的即时提醒,需要自行联系银行确认。
3.您支付的押金构成本合同下车辆物理损害的赔偿限额。(不包括误工费和劳务费。)
X.您的财产。您免除我们、我们的代理人和员工对于我们收到、处理或存储的,或留在车辆内或任何服务车辆内或我们办公室内的您的个人财产(包括车辆)或任何其他人的财产的所有损失或损坏的所有索赔,无论损失或损坏是由我们的疏忽造成的还是其他方面我们的责任。
XI.违反合同。上述第5段列出的行为是对车辆的禁止使用和违反本合同。您放弃对我们因您违反本合同而对您进行的任何刑事报告或起诉的所有追诉权。
XII.修改。除非我们签署的书面文件外,本合同的任何条款不得放弃或修改。如果您希望延长租赁期限,您必须将车辆归还至我们的租赁办公室进行检查,并由我们书面修订到期日。本合同构成您和我们之间关于此次租赁的全部协议。您和我们之间关于此次租赁的所有先前陈述和协议均无效。
XIII.杂项。我们对本合同的任何违约行为的豁免不构成对任何其他违约行为的豁免或放弃对您在本合同下义务的履行。我们接受您的付款或我们未能、拒绝或忽略行使本合同下的任何权利,不构成对本合同任何其他条款的放弃。除非法律禁止,您免除我们因本次租赁或预订车辆而产生的任何间接、特殊或惩罚性损害的任何责任。如果本合同的任何条款被认定为无效或不可执行,其余条款仍有效且可执行。
超级豪华车辆租赁(超级+或更高型号)需要额外的补充协议。
Car Rental Agreement
I. Definitions."Agreement" means all terms and conditions found on both sides of this form."You" or "your" means the person identified as the customer elsewhere in this Agreement, any person signing this Agreement, any Authorized Driver and any person or organization to whomcharges are billed by us at its or the customer’s direction. All persons referred to as "you" or"your" are jointly and severally bound by this Agreement. "We", "our" or "us" means thebusiness named on the reverse side of this Agreement. "Authorized Driver" means the renterand any additional driver listed by us on this Agreement, provided that person has a validdriver's license.Only Authorized Drivers may operate the Vehicle. "Vehicle" means the automobile or truck identified in this Agreement and any vehicle wesubstitute for it, and all its tires, tools, accessories, equipment, keys and vehicle documents. "CDW" means Collision Damage Waiver. "Physical Damage" means damage to, or loss of, theVehicle caused by collision or upset; it does not include comprehensive damage or loss, such as:loss of the Vehicle due to theft; vandalism; act of nature; riot or civil disturbance; hail, flood; or,fire. Physical Damage excludes interior burn holes, window stars or cracks not caused by collision or upset. "Loss of use" means the loss of our ability to use the Vehicle for any purpose caused by damage or loss during this rental. Loss of use is calculated by multiplying the number of days from the date the Vehicle is damaged or lost until it is repaired or replaced, times the daily rental rate.
II. Rental, Indemnity and Warranties. This is a contract for the rental of the Vehicle. We may repossess the Vehicle at your expense without notice to you, if the Vehicle is abandoned or used in violation of law or this Agreement. You agree to indemnify us, defend us and hold us harmless from all claims, liability, costs and attorney fees we incur resulting from, or arising out of, this rental and your use of the Vehicle. We make no warranties, express, implied or apparent, regarding the vehicle, no warranty of merchantability and no warranty that thevehicle is fit for a particular purpose.
III. Condition and Return of Vehicle. Exchange the car.You must return the Vehicle to our rental office on the date and time specified in this Agreement, and in the same condition that you received it, except for ordinary wear. If the Vehicle is returned after closing hours, you remain responsible for the safety of, and any damage to, or loss of, the Vehicle until we inspect it upon our next opening for business. Service to the Vehicle or replacement of parts or accessories during the rental must have our prior approval. You must check and maintain all fluid levels.
1.Vehicle Return Time The return time is the same as the pickup time. For example, if you pick up the car at 3 PM, you must return it by 3 PM on the return day.
Our business hours are 9:00 AM - 7:00 PM. If you need to return the car outside these hours, a fee of $1 per minute will be charged.
2. If you prepay a deposit and request a vehicle change at pick-up, you can switch to another rental vehicle not currently booked, but the deposit is non-refundable and non-exchangeable.
3. Extending the Rental Period To extend the rental, notify us 24 hours before the return time. We will confirm and charge you the rental price on the day of extension.If you inform us later than 24 hours after the return time, an additional $200 late fee will be charged on top of the extended rental price.If you inform us of the extension after exceeding the return time, an additional $500 late fee will be charged on top of the extended rental price.If you fail to return the vehicle on time and we cannot contact you, we reserve the right to tow the vehicle and charge you for towing, parking, labor, etc.
4. We don’t agree Exchanging the car After completing rental formalities and driving the vehicle off the premises due to personal preferences. If you insist on exchanging the vehicle, means this car’s rental period is ending and you start to rent a new car and start a new agreement.
IV. Responsibility for Damage or Loss; Reporting to Police. You are responsible for all loss or theft of, or damage to, the Vehicle, which includes the cost of repair, or the actual cash retail value of the Vehicle on the date of the loss if the Vehicle is not repairable or if we elect not to repair the vehicle, plus loss of use, diminished value of the Vehicle caused by damage to it or repair of it, and our administrative expenses incurred processing the claim. You must report all accidents or incidents of theft and vandalism to us and the police as soon as you discover them.
V. Damage Waiver. If you purchase the Collision Damage Waiver (CDW) and pay the fee upon returning the vehicle, we will waive our right to charge you for the physical damage to the vehicle. (The damage waiver insurance is only applicable to drivers aged 21 and above. If you are under 21, you will be responsible for all losses incurred.)We will not waive this right if damage to the Vehicle: (a) is caused by anyone who is not an Authorized Driver, or by anyone whose driving license is suspended in any jurisdiction; (b) is caused by anyone under the influence of prescription or non‐prescription drugs or alcohol; (c)is caused by anyone who obtained the Vehicle or extended the rental period by giving us false, fraudulent or misleading information; (d) occurs while the Vehicle is used in furtherance of any illegal purpose or under any circumstance that would constitute a violation of law, other than a minor traffic violation ; (e) occurs while carrying persons or property for hire or while pushing or towing anything, or in any race, speed test or contest; (f) occurs while teaching anyone to drive; (g) occurs while carrying dangerous or hazardous items or illegal materiel in or on the Vehicle; (h) occurs outside the geographic limitations indicated on the reverse; (i) occurs when it is loaded beyond its capacity; (j) occurs as a result of driving the Vehicle on unpaved roads; (k) occurs while transporting more persons than the Vehicle has seat belts, or while carrying persons outside the passenger compartment; (l) occurs while transporting children without approved child safety seats as required by law; (m) occurs and the odometer has been tampered with or disconnected; (n) occurs when the vehicle's fluid levels are low, or it is otherwise reasonable to expect you to know that further operation would damage the vehicle; (o) results from inadequately secured cargo; (p) where applicable, is caused by anyone who lacks experience operating a manual transmission; (q) is a result of your willful, wanton or reckless act; (r) occurs and you fail to summon the police to any accident involving personal injury or property damage; or, (s) is caused by an animal transported in the Vehicle.
VI. Mechanical Failures and Human-caused Situations During Rental
1.We are responsible for mechanical failures such as engine, transmission, chassis, brakes, etc., occurring during use.You may visit our designated repair shops for inspection and repair. If the vehicle is found to have inherent issues, we will replace it with a vehicle of equivalent value.During the rental period, maintenance can be performed free of charge at our designated repair shops within the allowed mileage limit.If any mechanical warning lights come on during use, contact us immediately to ensure driving safety.
2.It’s Renter Responsibility for Human-caused Situations.Human-caused situations include: tire blowouts, vehicle battery discharge, car break-ins, window damage, theft of items inside the car.We will not reimburse cash losses. Keep your valuables safe and do not leave them in the car. We provide 24-hour rescue services contact informantion but you need to contact and pay for these services.
VII. Insurance. You are responsible for all damage or loss you cause to others. You agree to provide auto liability, collision and comprehensive insurance covering you, us and the Vehicle. Where state law requires us to provide auto liability insurance, or if you have no auto liability insurance, we provide auto liability insurance (the “Policy”) that is secondary to any other valid and collectible insurance whether primary, secondary, excess or contingent. The Policy provides bodily injury and property damage liability coverage with limits no higher than minimum levels prescribed by the vehicular financial responsibility laws of the state whose laws apply to the loss. You and we reject PIP, medical payments, no‐fault and uninsured and under‐insured motorist coverage, where permitted by law. The Policy is void if you violate the terms of this Agreement, or if you fail to cooperate in any loss investigation conducted by us or our insurer.
VIII. Charges. You will pay us, or the appropriate government authorities, on demand all charges due us under this Agreement, including, but not limited to: (a) time and mileage for the period you keep the Vehicle, or a mileage charged based on our experience if the odometer is tampered with or disconnected; (b) charges for additional drivers; (c) optional products and services you purchased; (d) fuel, if you return the Vehicle with less fuel than when rented; (e) applicable taxes; (f) all parking, traffic and toll violations, fines, penalties, forfeitures, court costs, towing, impound and storage charges and other expenses involving the Vehicle assessed against us or the vehicle, unless these expenses are our fault; (g) $50, plus $5/mile for every mile between the renting location and the place where the Vehicle is returned, repossessed or abandoned, plus all other expenses we incur in locating and recovering the Vehicle if you fail to return it or if we elect to repossess the Vehicle under the terms of this Agreement; (h) all costs,including pre‐ and post‐judgment attorney fees, we incur collecting payment from you or otherwise enforcing our rights under this Agreement; (i) $100 per day late payment fee , or the maximum amount allowed by law on all amounts past due; (j) $50 or the maximum amount permitted by law, whichever is greater, if you pay us with a check returned unpaid for any reason; and (k) a reasonable fee not to exceed $350 to clean the Vehicle if returned substantially less clean than when rented.

2. Excess mileage costs incurred during the rental period will be deducted from the deposit (mileage limits for different cars and excess mileage prices will be explained at the time of car handover; generally set at 125 miles/day, 800 miles/week, 2000 miles/month detailed will show on agreement). You can Upgrade to unlimited mileage by paying a certain percentage of the rental fee, or pre-purchase miles at half the excess mileage price before you sign the agreement.
3. Fuel Charge: Return the car with the same amount of fuel as at the start. If returned with less fuel, the corresponding fuel cost need to be paid. (approximate standard: Japanese cars $20/quarter, German cars $25/quarter with extra $10 labour fee).
4. Claning:General cleaning: $20 - $300 b. Liquid cleaning: $200 c. Pet hair cleaning: $300 d. Odors (e.g., marijuana): $300
5. Estimated Costs for Vehicle Part Damages (These are estimated amounts; actual costs will be based on repair bills. Luxury brands may vary in price.)
Paint: $300 Plastic parts: $300 Glass: $300 - $1000 Tires: $200 - $400 (if not replaced after a blowout)
Rims: $200 - $600 Bodywork: $500 Seats: $700 - $1500 Mirrors: $300 - $800
IX. Deposit. We may use your deposit to pay any amounts owed to us under this Agreement.
1. Deposit Amounts
Economy Class Vehicles (usually priced under $50,000 USD):$500 / $1000
Luxury Class Vehicles (usually priced between $50,000 USD and $75,000 USD):$1000 / $1500
Ultra-Luxury Class Vehicles (priced $75,000 USD and above):$2000 / $5000
Deposit Refund Policy Deduction of Fees:
a. Any vehicle damage (excluding the deductible but not exempting downtime fees), toll fees and service charges, fines and service charges, towing fees, labor costs, fuel/electricity charges, parking fees, overtime fees, etc., will be deducted from the deposit. Detailed explanations of each deduction will be provided after the vehicle is returned.
b.Toll/Fine Deposit Freeze:Due to the lengthy process of checking toll fees/fines in the US, we will freeze $200 of the deposit to cover parking fees, toll fees, and related service charges. The remainder of the deposit will be refunded within one business day (1~3 calendar days) after the vehicle is returned.
c.Credit Card Information Record:You authorize us to record your credit card information used for the deposit payment, in case additional charges related to the contract arise after the full deposit has been refunded.
d.Credit Card Pre-Authorization Explanation:Credit card pre-authorization does not incur actual charges; we only freeze a portion of your credit limit. The time required to lift the freeze varies by bank, and banks do not provide immediate notifications. Please contact your bank for confirmation.
The deposit you pay constitutes the limit of compensation for vehicle physical damage under this contract. (Loss of earnings and labor costs are not included.)
X. Your Property. You release us, our agents and employees from all claims for loss of, or damage to, your personal property (including a vehicle) or that of any other person, that we received, handled or stored, or that was left or carried in or on the Vehicle or in any service vehicle or in our offices, whether or not the loss or damage was caused by our negligence or was otherwise our responsibility.
XI. Breach of Agreement. The acts listed in paragraph 5, above, are prohibited uses of the Vehicle and breaches of this Agreement. You waive all recourse against us for any criminal reports or prosecutions that we take against you that arise out of your breach of this Agreement.
XII. Modifications. No term of this Agreement can be waived or modified except by a writing that we have signed. If you wish to extend the rental period, you must return the Vehicle to our rental office for inspection and written amendment by us of the due‐in date. This Agreement constitutes the entire agreement between you and us. All prior representations and agreements between you and us regarding this rental are void.
XIII. Miscellaneous. A waiver by us of any breach of this Agreement is not a waiver of any
XIV. additional breach or waiver of the performance of your obligations under this Agreement. Our acceptance of payment from you or our failure, refusal or neglect to exercise any of our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. Unless prohibited by law, you release us from any liability for consequential, special or punitive damages in connection with this rental or the reservation of a vehicle. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable.
Luxury vehicle rentals (super+ or higher models) require an additional supplemental agreement.
